Supreme Court rules for same-sex couples

The Eagle-Tribune

---- — WASHINGTON (AP) — The Supreme Court says legally married same-sex couples should get the same federal benefits as heterosexual couples.

The court invalidated a provision of the federal Defense of Marriage Act earlier today that has prevented married gay couples from receiving a range of tax, health and retirement benefits that are generally available to married people. The vote was 5-4.

From the opinion: "DOMA is unconstitutional as a deprivation of the equal liberty of persons that is protected by the Fifth Amendment."

"DOMA singles out a class of persons deemed by a State entitled ot recognition and protection to enhance their own liberty."

5-4 decision written by Kennedy, dissents Roberts, Scalia, Alito, Thomas.
