Convicted sex offender faces new charges in Londonderry

Alleged victim said they met through smartphone app

LONDONDERRY — A registered sex offender has been charged with sexually assaulting a mentally challenged man in a parking lot earlier this month.

Brian Davis, 48, of Franklin was arrested on four felony charges at his home late Monday night, Detective Christopher Olson said yesterday. He’s being held on $250,000 cash bail.

Davis and his alleged victim, a 21-year-old mentally challenged man, met through an online dating site, available as a smartphone application, Olson said.

A brief Internet search yesterday turned up what appeared to be Davis’s profile on at least two sites designed to connect people with like interests, dating or otherwise.

The two apparently had been talking through the app for about a month before they agreed to meet in Londonderry for coffee, Olson said.

The alleged victim might not have known that Davis has a criminal record and is required to register as a sex offender.

Davis was convicted of sexual assault in December 2005 and again in January 2009, and also was convicted of simple assault in March 2010, according to N.H. Department of Safety records.

The alleged victim told police he and Davis were in a dark parking lot behind Apple Tree Cinemas 12 at 16 Orchard View Drive on the night of June 4. It was there, the man told police, that Davis sexually assaulted him.

The alleged victim then walked to Dunkin’ Donuts at 1 Mohawk Drive, told workers there he had just been assaulted, then locked himself in the restaurant bathroom, Olson said.

A relative took the 21-year-old man to a local hospital to be evaluated, Olson said.

Franklin police took Davis into custody just before 11 p.m. Monday, then drove down Interstate 93 and met Londonderry police in Canterbury, Olson said.

Davis was charged with three counts of aggravated felonious sexual assault and one count of felonious sexual assault.

He was held overnight Monday on $75,000 cash bail.

Davis was arraigned yesterday morning in 10th Circuit Court in Derry and his bail was increased to $250,000 cash.

He’s due back in court Monday.
