Developer seeks delay in hearing over 240 apartments

---- — NORTH ANDOVER — The Zoning Board of Appeals hearing on a plan to build 240 apartments on Berry Street, initially scheduled for 7 tonight at City Hall, will be postponed.

Eric Loth, director of North Andover Holdings LLC, the firm that wants to build the apartments, said he has revised the plans and will ask for the postponement.

Jeffrey Moon, president of the Berry Street Neighborhood Association which opposes the project, said he and other members of the group met recently with Loth and Louis Minicucci, one of the principals of North Andover Holdings LLC.

The developer initially proposed constructing five buildings with 48 apartments each. The plan has been changed to four buildings but with the same total of 240 apartments, according to Moon.

North Andover Holdings LLC has applied for a permit to build the apartments under Chapter 40B, the state law that exempts projects from local zoning regulations if at least 25 percent of the homes being built are set aside for people earning below-average incomes.

Chapter 40B, sometimes called the anti-snob zoning law, does not apply to communities where at least 10 percent of homes are considered affordable by the state Department of Housing and Community Development. North Andover does not meet that threshold.
