Andover man charged with nursing-home assault

ANDOVER — A 58-year-old Dascomb Road resident has pleaded not guilty to charges he sexually assaulted an elderly relative at an Andover nursing home.

John Bangert, 75 Dascomb Road, was arrested last Thursday and charged with assault and battery on a person 14 or older, incest and rape. He was arraigned Friday.

The charges stem from an incident late on March 5 at the Wingate Nursing Home at 80 Andover St. The victim has been a resident of the nursing home since October 2011. A police report said she cannot speak or eat or move on her own after suffering a stroke.

The report said a nurse who entered the room to check the victim’s catheter saw Bangert commit the sexual assault. Bangert’s sister, Barbara, was in the room at the time but did not react, the report said. She has not been charged.

Bangert was held but later released on $2,500 cash bail. He has no prior record and has lived in the area for over 40 years, according to court documents.

Bangert said he could not comment when reached at his home Monday. He denied any wrongdoing when questioned by police last week.

He is required to stay away from the victim and Wingate Nursing home. A probable cause hearing is scheduled for May 8.

Officials with Wingate Healthcare said medical privacy laws prohibited them from commenting.
