---- — ANDOVER — A 17-year-old boy was arrested Sunday after admitting to police he “mistakenly” shot a man with a BB gun as he was jogging by, police said.
Daniel Jimenez, 17, 500 Brookside Drive, was arrested for assault and battery with a dangerous weapon and was arraigned yesterday and released with a bail warning.
Police responded to 132 North St. around 1:157 p.m. Sunday after a man from Lawrence called police saying he was shot by a BB gun, according to a police report. The man said he saw three boys in the side yard of 132 North St. laughing.
“He stated he started to approach the individuals via the driveway when he noticed (one) male holding a BB gun rifle,” the report read. The three boys took off into the woods, the man told police.
The man stated he felt his right hip bone stinging and throbbing, but said because he had on extra layers of clothing it didn’t leave a mark.
After talking to Jimenez’s father, police were able to locate and speak to him.
Jimenez told police he was shooting the gun into the trees and “somehow mistakenly shot the man as he ran by,” according to the report.
Police noted in the report the street was in the opposite direction of the woods. When and officer asked him how this was possible, Jimenez responded by shrugging and smirking.
The BB gun, which had a scope mounted to the top, was taken as evidence, according to police.
The other two boys were spoken to about the seriousness of the incident.
