Londonderry school official sued for assault

Started when teen wouldn't take off hat

BRENTWOOD — A Londonderry High School assistant principal is accused of assaulting a student who refused to take off his hat in the school library.

Assistant principal Greg Warren allegedly forced Kyle Lynch from his chair and out of the library, causing the student to slam his head against a wall, according to a lawsuit filed against the school district in Rockingham Superior Court.

Lynch suffered a concussion and a “closed head injury” that required medical treatment after striking the wall Feb. 7, 2011, attorney James Walker claims in the lawsuit.

Warren, Superintendent Nathan Greenberg and principal Jason Parent are also named in the lawsuit.

The lawsuit was filed last week by Lynch and his father, Devin Lynch. The school officials are accused of failing to protect the boy.

The lawsuit alleges that Warren became angry when the teen was told to remove his hat and refused.

“Warren then physically assaulted the plaintiff Kyle Lynch by physically ejecting him from his seat, propelling him from the premises of the library and eventually hurling the plaintiff into a masonry wall, causing him to strike his head,” Walker said.

The incident left Kyle Lynch with “severe, painful and permanent injuries,” and caused him to suffer emotional and psychological trauma, Walker said.

The lawsuit does not specify the damages sought by the Lynchs. Kyle Lynch continues to incur medical expenses, Walker said.

When reached yesterday, Walker refused to comment on the case and the injuries suffered by his client.

“I’m not a doctor, but the medical records speak for themselves and the allegations in the complaint speak for themselves,” he said.

Greenberg said yesterday he had not seen the lawsuit yet and could not comment.

He confirmed that Kyle Lynch is no longer a student at the school. Warren could not be reached yesterday for comment.
