Man faces assault charges in death

BRENTWOOD, N.H. — The Rockingham County grand jury recently indicted David D. Janvrin Jr. on two counts of assault in the August 2008 case of the death of Scott Eaton at the former Old Firebarn Restaurant in Seabrook.

The indictment indicates the grand jury sitting earlier this month believes there was sufficient evidence in the case to warrant a trial.

According to the indictments released this week by the office of the Rockingham County attorney, Janvrin, 33, of 50 River St., Seabrook, is charged with one felony count each of simple assault and assault in the second degree.

Janvrin was charged after nearly a yearlong investigation by New Hampshire State Police in the death of Eaton, 42, of 252 South Main St., Seabrook. According to police, Eaton died from a head injury after a fight in the former Old Firebarn Restaurant on Route 286 in early August. According to witnesses, Eaton hit his head on a pool table as he fell.

Although the autopsy indicated Eaton's death was a homicide and from unnatural causes, homicide charges were never brought against Janvrin in the case by Seabrook police. Eaton pleaded not guilty in Hampton District Court to simple assault charges brought by Seabrook police, before the case was transferred to the office of the county attorney.

At the initial arraignment on Aug. 4 at Hampton District Court, Assistant Attorney General Ben Agati said proving the incident was a homicide would require proof Janvrin intended to kill Eaton, something difficult to prove.

The charges brought against Janvrin in this indictment were brought by Troop A of the New Hampshire State Police and not Seabrook Police Department.

Other indictments handed down by the Rockingham County Grand Jury during its recent June deliberations were:

Dana Abrahams, 46, 114 Blacksnake Road, Seabrook; two counts of felony burglary, brought by the North Hampton Police Department.

Alan Brien, 42, 316 Atlantic Ave., Seabrook; one felony count of forgery, brought by the Seabrook Police Department.

Dana Ellsworth, 32, 1 Kimberly Drive, Seabrook; two counts of aggravated felonious sexual assault, one count of felonious sexual assault, one count of criminal threatening, and two counts of simple assault, all felonies, brought by Seabrook Police Department.

Theresa Paquette, 44, 71 Coral Lane, Seabrook; four counts of felony receiving stolen property, two each brought by the Portsmouth and North Hampshire police departments.

Michael Silva, 21, 5 Maple Ridge Road, Seabrook; one felony count of theft by unauthorized taking and one misdemeanor charge of false report to law enforcement, brought by the Seabrook Police Department.

Eddie Sousa, 23, 16 Pine Cone Drive, Seabrook; one felony count of possession of a narcotic drug, one felony count of possession of a controlled drug, and one misdemeanor charge of resisting arrest or detention, brought by Seabrook Police Department.
