Windham's conflict ordinances ruled unconstitutional

WINDHAM – A Rockingham County judge has ruled invalid conflict-of-interest ordinances approved by voters earlier this year at Town Meeting.

Town Administrator David Sullivan said the ruling from Superior Court concluded the ordinances infringed on people’s constitutional rights.

Selectmen do not need to take any action at this point, Sullivan said. Selectmen had refrained from enforcing the ordinances, pending the court ruling.

Selectmen had gone to court after some residents expressed concerns they might no longer be able to volunteer or contribute to the town because the ordinances were too restrictive.

Bernard Campbell, the town’s attorney, told residents at the town deliberative session he believed the ordinances as written could be held unconstitutional.
