ANDOVER — A U.S. District Court judge in Oregon granted an injunction last week against a competitor of Smith & Nephew from making or selling a surgical instrument that infringes on a patent obtained by the local company for one of its medical devices.
The injunction prohibits Arthrex Inc., of Naples, Fla., from making or selling suture anchors used mostly in shoulder surgeries.
The device had originally been invented by Dr. John Hayhurst of Portland, Ore., who gave the patent to Smith & Nephew. The injunction takes effect on Jan. 18, 2009.
"We spend a significant amount of time and effort with surgeons to develop innovative technologies that provide real benefits to patients around the world," Michael Frazzette, president of Smith & Nephew Endoscopy, said. "We are fully committed to defending our intellectual property from being infringed by Arthrex or any other companies that violate our rights."
