HAVERHILL — A Haverhill chiropractor has been reindicted on fraud and conspiracy charges following an investigation by the state Attorney General's Office.

Dr. Troy Wheelwright, of River Front Drive, Amesbury, pleaded not guilty Thursday to three counts of filing false motor vehicle insurance claims and three counts of conspiracy in Salem Superior Court. He is the owner of Haverhill Family Chiropractic at 606 Broadway.

Wheelwright was not present for the arraignment but one of his lawyers, Ingrid Martin of the Boston law firm Dwyer and Collora, entered the plea on his behalf. Judge Timothy Feeley scheduled a pretrial conference for Dec. 7.

The latest indictment was returned Oct. 23. Superior Court Judge Howard Whitehead threw out an earlier indictment against Wheelwright and attorney Socrates De La Cruz last December after finding that prosecutors had failed to show probable cause that a crime had been committed.

"We told you he would be vindicated from Day One," attorney Paul Cirel said at the time. Cirel noted that Whitehead had allowed the motions to dismiss because there was never any evidence his client and De La Cruz had committed a crime.

Cirel and Martin are handling Wheelwright's defense. A receptionist at Haverhill Family Chiropractic referred all questions to Cirel.

"This case will not make it to trial," Cirel told The Eagle-Tribune yesterday. "Dr. Wheelwright is not guilty of any of these charges."

The attorney general's probes were prompted by the crackdown on auto insurance fraud in the wake of the September 2003 death of a 65-year-old great-grandmother from Lawrence, Altagracia Arias, who died in a staged crash that police said she helped plan to scam insurance companies.

The indictments against De La Cruz and Wheelwright stemmed from four allegedly staged crashes that occurred between October 2002 and February 2003. Cirel said chiropractors and physicians rely on their patients to be accurate "historians" of how they received their ailments.

"Dr. Wheelwright has an excellent reputation," Cirel said.

"Our office uncovered additional evidence against Troy Wheelwright where we felt that new indictments were warranted against him," said Harry Pierre, spokesman for Attorney General Martha Coakley.
