PLAISTOW — A lawsuit filed against the Planning Board over 55-plus housing has been put on hold.
Developer Ron Brown filed the equity suit last winter after being notified the full number of units he applied to build would not be considered. Brown filed more than one application, with the last one requesting more units than allowed under the town's elderly housing ordinance cap.
Brown is planning an appeal before the Zoning Board of Adjustment, according to paperwork from a court hearing late last month. The Superior Court judge will not rule in the case until after a decision is made on the appeal.
The Planning Board has scheduled a special meeting for Oct. 29 to begin hearing other 55-plus applications.
After a series of public hearings last year, applications were put on hold for various reasons, including Brown's case.
