METHUEN — After a year of probation, an assault and battery charge has been dismissed against a local man accused of kicking a 10-year-old boy.

Guy D'Ambrosio, 51, of 19 Glen Ave., was placed on pretrial probation and the case was continued without a finding for one year following his May 28, 2008, arraignment on a charge of assault and battery with a dangerous weapon, a shod foot.

The charge stemmed from an incident involving D'Ambrosio's 10-year-old son and another 10-year-old boy.

The two boys scuffled and when D'Ambrosio confronted the other boy, he flailed his arms and legs to distance himself from the man, according to police reports. D'Ambrosio then allegedly kicked the boy in the shin, police reports said.

The charge against D'Ambrosio was dismissed Oct. 29 in Lawrence District Court.

At a hearing Nov. 27 after dismissal of the charge, D'Ambrosio's court record was ordered sealed by a judge.
